3.2. Definitions Specific to Choose for Real
Real-Life Dating App: refers to the digital platform designed to help Users meet in person by facilitating social connections for the purpose of making friends, finding romantic partners, or other interactions. The App allows Users to connect virtually, but its primary objective is to encourage physical, real-life meetings.
Gift: refers to a digital icon accessible on the App, allowing a Chooser to send another Chooser a strictly virtual token of appreciation, with no monetary value and no transfer of funds between Users.
The Gift constitutes digital content as defined by applicable law and cannot be considered a means of payment, a financial instrument, or a money transfer transaction.
Sending the message is a voluntary act on the part of the sender, and its receipt is contingent upon the recipient’s free, specific, and unequivocal consent (opt-in). Refusal or failure to respond does not entail any obligation.
Acceptance of the Gift serves solely to unlock access to the internal messaging system, without creating any contractual, commercial, romantic, or marital commitment between Users.
Any associated processing of personal data is carried out in accordance with Regulation (EU) 2016/679 (GDPR) and the Application’s Privacy Policy. The Publisher acts exclusively as a technical service provider for matchmaking and cannot be held liable for exchanges between Choosers.
Chooser: refers to any natural person who is of legal age and legally competent, registered on the Choose for Real App to use its matchmaking services. In this capacity, the Chooser freely initiates or responds to interactions in a public meeting place (such as Winks, Drinks, Gifts, Flowers, or Songs), in accordance with these Terms of Use, without any contractual obligation arising between Users.
Wink: an emoji representing a subtle and playful gesture, designed to attract another User’s attention and initiate a lighthearted interaction.
It is a virtual action initiated by a User, consisting of sending a signal of interest or attention to another User, with the aim of starting an interaction. This gesture creates no obligation for the recipient, who is free to accept or decline this request. Accepting a “wink” does not create a contractual commitment or an obligation to communicate between the parties.
Flower: refers to a virtual action symbolizing an offer of attention or courtesy, sent by one User to another via Choose for Real, in a context of goodwill or romance. Acceptance or rejection of the flowers is left to the discretion of the recipient User; the Publisher cannot under any circumstances be held liable for the consequences of this interaction.
Dating Filters: refer to the specific criteria that Users can apply to find profiles of other Users that match their preferences regarding gender, age, and location.
Geolocation Interface: The App includes a geolocation feature that allows the Chooser to view their approximate geographic location as well as that of other Choosers nearby, in accordance with the privacy settings defined by each User. This interface allows the Chooser to set their location manually or automatically, in order to facilitate the discovery of profiles within the same geographic area and to encourage interactions leading to a potential in-person meeting.
Geolocation relies on voluntary activation by the Chooser, which can be deactivated at any time. The Publisher does not retain any location data beyond what is strictly necessary for the operation of the Service and excludes any permanent or systematic tracking of movements.
IRL (In Real Life): refers to an actual in-person meeting between “Choosers.” Unlike other apps that prioritize virtual interactions before moving on to a physical meeting, Choose for Real emphasizes an immediate and authentic connection. The App allows Users, after crossing paths in a public place, to break the ice by engaging in direct interaction through its features.
Text and voice messages: Text and voice messages are an internal communication feature available within the App.
Access to the « Messaging » feature is contingent upon a Chooser first sending a digital gesture available on the app (such as a Wink, a Flower, a Gift, a Drink, or a Song) and the recipient’s free, specific, and unequivocal acceptance of that gesture (opt-in).
This acceptance signifies mutual interest and is the sole condition for unlocking the private chat channel. It does not create any contractual commitment between Users, nor any obligation to meet, nor any obligation to continue the conversation.
Communications exchanged via the Messaging feature are the sole responsibility of the Choosers. The processing of personal data carried out in this context is conducted in accordance with Regulation (EU) 2016/679 (GDPR) and the App’s Privacy Policy.
The Publisher acts exclusively as a technical service provider making a digital communication service available and does not, under any circumstances, interfere with the content, nature, or purpose of exchanges between Users.
Music: refers to the virtual transmission of songs or music clips shared by one User with another through a partner platform, with the intention of creating a certain atmosphere or expressing emotions in a creative way. Whether to accept or decline a music send is determined solely by the recipient User; the Publisher does not intervene and cannot be held liable for the consequences of this interaction.
Opt-in: refers to the action by which a User actively and freely chooses to participate in an interaction or to give consent to receive a request, such as a « Clin d’œil » a « Verre » a « Cadeau » a « Fleur » or music.
Opt-in implies the User’s explicit and voluntary consent to initiate or continue a relationship, in a manner that respects their freedom of choice and privacy. Each User is free to opt out of or refuse any request, thereby ensuring that the interaction takes place respectfully, securely, and in accordance with the Application’s Terms of Service.
Opening line: a short, predefined message that a User can add to a « Drink » or « Gift » message to make their approach more authentic and engaging.
In-Person Encounter: Refers to a situation in which two Choosers are physically present in the same freely accessible public or private space (such as a bar, restaurant, party venue, or cultural venue), without necessarily having a prior connection, and are simultaneously logged into the App. When a Chooser identifies, via the geolocation interface, another Chooser nearby, they may express their interest by sending a « Wink » a « Drink » a « Gift » a « Flower » or a « Song » This is subject to the recipient’s express acceptance, which then triggers access to the App’s private messaging feature.
The App does not intervene in any way in the course or content of exchanges, exercises no control over meeting locations, and guarantees neither the nature, outcome, nor frequency of interactions initiated between Choosers.
Security: refers to the measures and features implemented on the Choose for Real App to guarantee the authenticity of profiles and ensure real and safe meetings. This includes verifying the identity of Choosers via a facial biometrics system, as well as the principle of meeting in public places, where Users first meet in person before interacting on the App, thereby eliminating the risks of fake profiles and fake dates.
Profile Verification: refers to a process in which the App validates a User’s identity to ensure the security and authenticity of profiles, thereby facilitating real-life meetings between trusted individuals.
Verre: refers to a digital icon accessible within the App, allowing a Chooser to send another Chooser a strictly symbolic invitation to share a friendly moment.
The « Verre » is a virtual gesture devoid of any monetary value and does not involve any transfer of funds between Users. It cannot be considered a financial transaction, a means of payment, or a commercial transaction.
Sending a « Verre » is a voluntary act on the part of the sending Chooser, and its receipt is contingent upon the recipient’s free, specific, and unequivocal acceptance (opt-in). Refusal or failure to respond does not entail any obligation or require justification.
Acceptance of the Verre serves solely to unlock the internal messaging feature, in accordance with these Terms of Use, without creating any contractual, commercial, romantic, or marital commitment between Users.
The Publisher acts exclusively as a technical service provider facilitating connections and cannot be held liable for interactions or exchanges between Choosers resulting from the sending or acceptance of a « Verre ».
- Scope of Application
These Terms of Use define the rights and obligations of the parties in connection with the use of Choose for Real. They form the basis of a contractual relationship between the User and the Publisher.
- Conflict of Standards
These Terms of Use (TOU) set forth the main rules governing the use of the Application. They are supplemented by the Privacy Policy, which provides the User with more specific guidance on how to use the Application. In the event of a conflict between the Terms of Use and the Privacy Policy that results in a lack of accessibility, clarity, and/or predictability of the rules, these Terms of Use shall take precedence over the Privacy Policy.
- Severability
In the event that any provision of these Terms of Use is declared null and void, unenforceable, illegal, or deemed unenforceable, in whole or in part, pursuant to a statutory or regulatory provision or a final decision by a competent court, only that provision shall be set aside, while the remaining provisions shall remain valid and enforceable. Such invalidity shall in no way affect the validity, legality, or enforceability of the other provisions herein, unless these Terms of Use are rendered meaningless or such invalidity results in a significant imbalance in the obligations of the parties.
The Parties agree that the clause thus invalidated shall, to the greatest extent possible, be replaced by a legally valid provision having an equivalent effect or, failing that, one consistent with the general spirit of the contract.
The partial invalidity of a clause or provision shall not result in the invalidity of the Terms of Use as a whole.
- Overview of the Application
- Description of the App
Choose for Real is a geolocation-based social networking app designed to make meeting people easier and more spontaneous for individuals who are in the same location, whether in public places, gatherings, or retail spaces. The idea behind Choose for Real is to break away from the traditional models of dating sites—often perceived as cold and impersonal—by offering a more authentic and realistic way to build connections in real life.
With Choose for Real, users can discreetly browse the profiles of others around them, and if a potential connection arises, the app makes it easy to reach out in a creative and engaging way. Users can send a text or voice message, a wink, or even thoughtful gestures such as a Drink, a Gift, a Flower, or a Song.
A User may then send a Drink, a Gift, Flowers, a Wink, or Music to another User directly through the App, in accordance with these Terms of Use. Receiving and accepting a Drink or a Gift opens the door to interaction and communication between the two Users.
All users have verified profiles to ensure the authenticity of interactions and the reliability of matches.
Beyond this interactive approach, Choose for Real aims to be a true social catalyst, making it easy and fun to break the ice. The entire process is centralized for a seamless and convenient experience.
Choose for Real restores the true meaning of meeting people in real life. It’s an app designed to encourage authentic human connections by helping Users start a conversation or create a unique moment with people they encounter in public places.
Each user is free to chat and build relationships with other users in accordance with these Terms of Service.
Under no circumstances may the Services offered be considered as counseling or matchmaking activities.
- Platform for Accessing Services
The Services are accessible to anyone with Internet access on a smartphone running a recent version of the iOS or Android operating system, provided they download the App from the App Store or the Play Store, as applicable.
The App provides access to all Services, subject to any applicable fees.
All costs associated with accessing the App, such as those related to paid features and expenses for hardware, software, or Internet access, are the sole responsibility of the Chooser.
- Services and Features
- Purpose of the Services
Choose for Real is designed to provide Choosers with a digital platform for social networking. This platform allows people in the same public location to connect via secure digital features, thereby fostering genuine and consensual interactions.
The services offered fall into two categories:
- Free services accessible to all Choosers, including, in particular, creating a profile, viewing profiles, and managing the number of suitors, etc.;
- Paid services, accessible via subscriptions, which allow users to send « Drinks » and « Gifts » as well as access other features.
The Publisher reserves the right to modify, suspend, or discontinue all or part of the Services, provided that Choosers are notified in accordance with the contractual provisions.
The Services are provided “as is” and may change at any time due to technical improvements, the Publisher’s strategic decisions, or legal requirements.
The Chooser acknowledges and agrees that the Publisher makes no guarantees regarding the quality or duration of interactions initiated through the App, as these depend solely on the free will and consent of Users.
- General Description of Choose for Real’s Services and Features
The Application’s services include, in particular:
- Sending "Verres" Digitally and Symbolically: A Chooser can, through the App, send a "Verre" to another Chooser by selecting the icon provided for this purpose. A « Glass » can only be sent by Users with an active subscription, and the recipient is free to accept or decline it, with no obligation to respond. If accepted, a private chat channel is automatically opened between the parties.
- Sending a Gift as a symbolic and confidential gesture: The Chooser can also express interest by sending a Gift, selecting the icon provided for this purpose. Gifts can only be sent by Users with an active subscription, and the recipient is free to accept or decline them without any obligation to respond. If accepted, the two Users can begin a conversation via the App’s messaging feature.
- Sending “Winks” to Initiate Contact: The Chooser can send a « Wink » to another Chooser in the same location using a dedicated icon within the App. A « Wink » is a digital, symbolic, and non-binding gesture intended to express interest discreetly. Receipt of a « Wink » is contingent upon the recipient’s free, specific, and unequivocal acceptance (opt-in). If the recipient expressly accepts, access to the internal messaging system is unlocked between the Choosers involved.
- Secure exchanges with verified profiles: Profiles displayed within the App undergo prior verification and certification according to a rigorous validation protocol, including, in particular, photographic checks and, where applicable, biometric verification. Only profiles that have successfully completed this validation process are authorized to access the App’s features, thereby ensuring authentic, secure interactions free of fake accounts.
- Instant Translation for International Matches: The App’s internal messaging system includes an instant automatic translation feature, available for both text and audio exchanges. This feature allows Choosers to communicate easily, in real time, without language barriers, when language differences are detected between Users.
- Text translation: All text conversations are automatically translated into each Chooser’s preferred language, enabling smooth and understandable exchanges.
- Audio translation: Voice messages can also be translated simultaneously, ensuring smooth communication during spoken interactions between Choosers who speak different languages. This feature is enabled by default as soon as different languages are detected.
- Voluntary geolocation interface: Choosers may, at their discretion, indicate their presence in a public place via the voluntary geolocation interface. This information is used exclusively to identify Users present in the same space, without specifying personal contact information or sharing it externally.
- Sending Flowers as a Symbolic Gesture: A Chooser with an active Subscription may send a Flower to another User, represented by a dedicated icon within the App’s interface. This symbolic, non-binding gesture allows the sender to express interest in an elegant way. The Flower may be freely accepted or declined by the recipient. If expressly accepted, an internal messaging channel is opened between the Choosers involved. The Flower does not create any contractual, commercial, romantic, or marital commitment between Users.
- Music Sharing: Similarly, a Chooser with an active Subscription may choose to share a music clip through the dedicated interface. This feature allows users to convey a mood, a message, or an emotion using a track selected from a library provided by the App. The recipient is free to accept or decline the shared music, with no obligation to respond. In the event of express acceptance, access to the internal messaging system is enabled between the relevant Choosers. This feature is optional and available only to subscribed Choosers.
- Functional Updates
The Publisher reserves the right to update the App’s Services and features, both in form and content, in order to improve their relevance or ensure legal compliance. Any substantial modification will be notified to the Chooser in accordance with the terms set forth in these General Terms and Conditions.

The terms and conditions regarding payment, automatic renewal, and cancellation of Subscriptions are governed by these Terms of Use, in accordance with applicable law.
- Subscription Plans
Through Choose for Real, the Publisher offers three Subscription plans providing access to a set of Services and features described in Section 8.3 of these Terms. These plans consist of fixed-term Subscriptions, at the Chooser’s discretion, namely:
- a daily Subscription;
- a weekly Subscription; or
- a monthly subscription.
The Subscriptions offered confer identical rights with respect to the available features. The only difference between them is the commitment period chosen by the Chooser at the time of subscription.
Subscribing to any of the Subscriptions constitutes unconditional acceptance of the Terms and Conditions in effect on the date of subscription, including those relating to duration, price, automatic renewal terms, cancellation, and the exercise of the right of withdrawal, if applicable.
- Services Accessible Through Subscriptions
The Subscription purchased by the Chooser entitles the user, for the entire duration of its validity, to access all free features available on the App—with the exception of the “Wink” feature—as well as the specific Services described below:
- Sending a symbolic « Verre »;

- Payment Terms
Payment for Subscriptions offered on the App is processed through duly authorized third-party payment service providers, including the Apple App Store or Google Play Store, depending on the device and purchase method selected by the User.
Payment is due upon conclusion of the contract for the entire Subscription period.
The Publisher has no control over the payment, currency conversion, or the transfer of funds itself, nor over any fees associated with these transactions. Consequently, the Apple App Store or Google Play Store are solely responsible for the terms and conditions of payment and the payment transactions.
For this reason, the Publisher has no authority to issue refunds for the Subscription purchased by the Chooser. Any payment-related inquiries must be directed to the Apple App Store or Google Play Store.
The Publisher does not collect any banking information. Banking information is collected and processed directly by the Apple App Store or Google Play Store and remains outside the Publisher’s control.
- Pricing and Billing
Prices are listed primarily in euros (EUR), inclusive of all taxes (TTC), unless otherwise stated. The applicable price is the one displayed at the time the order is confirmed or the Subscription is purchased. The total amount due is payable immediately and in full at the time of the transaction.
- Term and Automatic Renewal
Subscriptions offered on Choose for Real are entered into for a fixed term—namely, daily, weekly, or monthly—depending on the plan selected by the Chooser at the time of registration.
If the Chooser chooses to subscribe to a Choose for Real Subscription, they will be bound by the terms of the subscription starting from the date of subscription and for the entire selected subscription period. In the event of cancellation by the Chooser before the end of the commitment period, the amounts paid to the Publisher for that period will be retained by the Publisher and will not be refunded to the Chooser.
With the exception of the Daily Subscription, which is non-renewable, Weekly and Monthly Subscriptions are automatically renewed by default unless the Chooser opts out through the platform on which the Chooser subscribed—Apple’s App Store or Google’s Play Store.
The Daily Subscription is not subject to automatic renewal, in accordance with platform requirements and applicable regulations. It consists of a one-time, non-renewable 24-hour access period, available at the Chooser’s request, with no commitment beyond that period.
If the Subscription is renewed and upon receipt of the payment processed automatically through the Store selected by the Chooser, the Publisher validates the purchase and updates the Account, granting the Chooser access to the Choose for Real App for the subscribed duration.
The Chooser may disable the automatic renewal of their Subscription at any time, directly from the purchase platform used (Apple App Store or Google Play Store), no later than 24 hours before the end of the current Subscription period:
- On the Apple App Store (iOS), follow these steps:
- Go to Settings> [ Your Name]> Subscriptions.
- Select the relevant subscription.
- Tap Cancel Subscription to prevent automatic renewal.
- You’ll continue to enjoy the services until the end of the paid period.
- On the Google Play Store (Android):
- Open the Google Play Store app
- Tap Menu> Subscriptions
- Select the subscription you want to change
- Tap "Cancel Subscription," then confirm.
- The subscription will remain active until it expires.
Therefore, if the Chooser wishes to prevent this automatic renewal at the end of the Subscription period set by the Stores, they must disable it.
- Right of Withdrawal
As stated in Section 8.4 of these Terms of Service, payments are processed and managed entirely by the Apple App Store and the Google Play Store; therefore, the right of withdrawal, if applicable, must be exercised directly with the Apple App Store or or the Google Play Store, by notifying their respective services of the user’s decision to withdraw by submitting the withdrawal form provided for in Article R221-1 of the French Consumer Code or any other unambiguous statement expressing the user’s intention to withdraw.
Consequently, any request to cancel a paid service purchased through the App must be addressed directly to Apple Inc. and/or Google LLC and will be processed in accordance with their terms and conditions.
The Chooser must submit the request from their smartphone via the App Store and/or the Google Play Store and follow the procedures required by Apple Inc. and/or Google LLC.
In accordance with the provisions of the Consumer Code, the Chooser has 14 business days from the date of delivery of their order to request a refund from Apple’s App Store or Google’s Play Store for any unused paid Services.
However, if the Services offered as part of the Subscriptions are fully used through the App before the end of the aforementioned withdrawal period, the Chooser expressly agrees that the Publisher may immediately perform this service and expressly waives the right to exercise the right of withdrawal in accordance with the provisions of Article L122-28-1° of the Consumer Code.
- Restoring a Subscription
When using Choose for Real on mobile devices, the Chooser has the option to restore a previously purchased Subscription, particularly in the event of reinstalling the App or changing devices.
It is expressly stated that Subscriptions are linked to the personal account used on the relevant download platform (Apple App Store for iOS Users, Google Play Store for Android Users), and not to the local installation of the App.
Consequently, if the Chooser has uninstalled the App, switched devices, or encountered a malfunction preventing them from retrieving an active Subscription, it is their responsibility to use the “Restore a Previously Purchased Subscription” feature, accessible from the App’s settings. This option allows the User, once logged in with the same Apple or Google account used for the original purchase, to reactivate access to the subscribed Services at no additional cost.
The Publisher assumes no liability in the event that restoration is impossible due to an account error, the deletion or suspension of the Apple/Google account, or any issue attributable to the distribution platforms.
- Subscription Cancellation
Deleting the Account by the Chooser or uninstalling the App from the smartphone does not cancel or remove Subscriptions.
To cancel a Subscription, the Chooser may at any time go to the Subscription management settings in the Apple App Store or the Google Play Store, as indicated below:
To cancel a subscription on the Apple App Store, you must:
- Open the Settings app> [ Your Name]> Subscriptions.
- Select the subscription you want to manage.
- Tap “Cancel Subscription.”
To cancel a subscription on the Google Play Store, follow these steps:
- Open the Google Play Store app
- Make sure you’re signed in to the correct Google account.
- Click on Menu> Subscriptions
- Select the subscription you want to cancel
- Tap "Cancel Subscription," then confirm.
Canceling a subscription does not result in a refund for the period already used.
The Publisher has no control over subscription payments. Consequently, since the Apple App Store and the Google Play Store are solely responsible for payment terms and transactions, and the Publisher has no authority to issue refunds for purchases of paid Services, any payment-related requests must be directed to the relevant store.
- Changes to the Subscription Terms
The Publisher reserves the right to modify the Subscription Terms, including pricing and the features offered, at any time.
These changes will take effect 15 days after their publication on the App, the landing page, and/or the Choose for Real App website.
However, it is the Chooser’s responsibility to regularly check the App, the landing page, and/or the Choose for Real App website to review any changes.
The Chooser’s continued use of the App after the effective date of the changes constitutes acceptance of those changes.
If the Chooser does not accept the changes, they may cancel their Subscription in accordance with the terms set forth in Section 11.3 of these Terms.
- Liabilities
The Publisher disclaims all liability for any errors, delays, or interruptions related to third-party payment platforms, as well as any difficulties encountered by the Chooser in managing their Subscription (modification, renewal, cancellation, etc.).
- Banking Information and Payment Processing
In connection with the use of the Application and access to it via the Subscription, banking information may be required to facilitate the processing of transactions.
- Payment Providers
Payments made within the App are processed exclusively by third-party payment service providers, namely the Apple Store and the Google Store.
The User expressly acknowledges that:
- Payment information is transmitted directly to the selected provider (Apple or Google) via secure interfaces;
- the Publisher does not collect, process, or store any banking or financial data during the payment process;
- The Publisher shall not be held liable in the event of a transaction refusal, error, double charge, technical malfunction, or any dispute arising between the Chooser and the aforementioned service providers.
- Processing Terms
The banking information provided by the Chooser in connection with a payment is processed in accordance with the respective privacy policies of Apple and Google.
It is the Chooser’s responsibility to review these policies to understand the terms applicable to their Personal Data and their rights.
- Requests or Disputes
Any complaint, refund request, or dispute regarding a payment transaction must be addressed directly to the relevant service provider, in accordance with the procedures established by that provider.
The Publisher shall not be held liable for any consequences of a refusal, delay, or failure to issue a refund attributable to these service providers.
- Registration and Terms of Access to the Services
- Conditions of Access to the Services
Access to the Services offered on the App is strictly reserved, at their sole responsibility, for natural persons of legal age (over 18 years old) who have legal capacity, meet the conditions described in Section 12.2 below, and have previously accepted these Terms of Use without reservation.
Registration is required for any use of the App’s interactive features. It involves creating a personal account using the form provided for this purpose, providing accurate, complete, and up-to-date information, and explicitly accepting these Terms of Use.
The Publisher reserves the right to deny or suspend access to any User who fails to comply with these Terms.
Registration on the platform is free.
By tapping the button labeled “Sign In with Apple” or “Sign In with Google,” the User expressly and fully accepts, without condition or reservation, these Terms of Use, including those mentioned in the User Code of Conduct defined in Article 12 below.
The User may freely view these Terms of Service at any time on the App by selecting the “Settings” tab, as well as on the Website and/or the landing page www.chooseforreal.com.
- Creating a Chooser Account
Access to the App requires, after downloading it, the creation of an Account.
An Account is created as follows:
- By completing the form provided for this purpose and providing a valid identifier (valid email address and/or phone number), creating a secure password, and adding one or more profile photos. The User guarantees the authenticity of the information provided and agrees not to impersonate a third party or use a false identity.
- Through a third-party authentication process offered by recognized digital identity providers, including Apple Inc. (Apple ID) or Google LLC (Google Sign-In). In this case, the User must enter the information assigned to them based on their civil status, namely their first name, gender, and date of birth. Verification of the scanned photos is performed by the service provider “Regula.”
When the User chooses to create an Account via a third-party service, they expressly consent to the Publisher accessing, collecting, and processing certain identifying Personal Data (such as last name, first name, email address, profile picture, or any other information strictly necessary for creating the Account), in accordance with the privacy settings defined by the User with the third-party provider and the terms of the Application’s Privacy Policy.
The Publisher shall not be held liable for any errors, malfunctions, or loss of access to the Account resulting from an incident or restriction affecting the third-party service used. It is the User’s responsibility to maintain functional access to their Apple or Google ID, which is an essential requirement for the proper functioning of their Account.
If the Apple or Google Account linked to the authentication process is deleted, access to the User’s Account within the App may be compromised. The Publisher shall not be held liable for any loss of data, content, or Services resulting from such external deletion.
The Publisher reserves the right to verify the validity of any authentication performed via third-party services and, in case of doubt or suspected fraud, to temporarily or permanently suspend access to the Account in question, in accordance with the provisions herein.
Creating an Account implies acceptance of these Terms of Use, as well as the Privacy Policy.
- Account Monitoring
The Publisher uses various automated tools, reports from Users, and a moderation team to monitor User Account activity and Content in order to identify any breaches of these Terms of Use.
In the event of a suspected violation of the Terms of Use, and more specifically, of the User Code of Conduct defined in Article 12 herein, the Account may be suspended at any time to verify whether such a violation has occurred.
As part of this investigation, the Publisher may need to request information from the User in question to assess compliance with these Terms of Use and the aforementioned Code of Conduct, including Personal Data such as the phone number and/or email address associated with the User’s Account for the purpose of authenticating the User.
If a violation is confirmed, the corresponding Account may be automatically deleted by the Publisher, and the User in question may be banned from the Application.
In any case, the Publisher reserves the right to delete or suspend the Account, restrict access to the Application, or use any technical, operational, or legal means at its disposal to enforce the Terms of Service (including blocking IP addresses).
If the User is a resident of the European Union (“EU”), the Publisher will notify the User of any action taken against the User’s Account or its content, unless such notification is inappropriate (for example, when it is not permitted by the authorities). For other Users, the Publisher may take such measures at any time without prior notice to the User and without incurring any liability.
If the User believes that the Publisher has made a mistake in taking action against their Account or Content, they may file an appeal against this decision by following the procedure outlined in the Application or by contacting the Publisher directly at the following address:
As a User residing in the EU, the User also benefits from the following additional rights under the Digital Services Act:
- The right to choose an alternative dispute resolution body;
- The right to seek judicial remedy before the courts of the EU Member State in which the User resides; and
- The right to file a complaint with the competent national regulatory authority
- Account Security
The User Account is strictly personal and individual. It may only be used by its holder.
The User may only have one Account. Using the Application’s Services through multiple Accounts constitutes a serious breach of these Terms of Service.
Similarly, the login credentials for the Apple or Google ID are personal and confidential. The User is solely responsible for their use.
The User is solely responsible for the consequences of using their Account and acknowledges that any connection or data transmission made using their login credentials will be deemed to have been made by them.
- Receipt of Unsolicited or Fraudulent Emails
The Publisher informs Users that all official communications will be sent exclusively from the email addresses listed in the App or on the official Landing Page and/or Website.
The User agrees to protect themselves against any exceptional risk of receiving unsolicited emails or emails purporting to be from the Publisher.
The User must remain attentive and vigilant so that, should such situations arise, they may notify the Publisher by sending a letter or email to the addresses provided in Article 27 herein.
If the User receives suspicious emails or messages purporting to be from the Application’s Publisher (phishing, attempts to collect Personal Data or banking information, etc.), the User is advised to:
- Never click on any links contained in these messages;
- Never disclose their login credentials or banking information;
- Immediately report the attempted fraud to the following address: contact@chooseforreal.com
The Publisher assumes no liability for any fraudulent use of an Account resulting from the User’s failure to exercise due diligence.
- Logging Out, Uninstalling, and Deleting the Account by the Chooser
- Logging Out of the Account
The Chooser may, at any time, log out of their personal Account via the Application’s interface, without this resulting in the deletion of said Account or the termination of any Subscription or Service they have subscribed to.
Logging out merely temporarily suspends access to the personal account on the device being used. Re-authentication will be required for any subsequent access.
It is the Chooser’s responsibility to take all necessary measures to ensure the confidentiality of their login credentials and the security of their devices. In particular, the Chooser is expressly informed that failing to log out of their Account on a shared device or one accessible to third parties may allow for fraudulent or unauthorized use of their Account, for which the Publisher shall in no event be held liable.
The Chooser acknowledges that any activity carried out on their Account following a failure to log out intentionally is presumed to have been carried out by them, unless proven otherwise.
In the event of a suspected compromise of their Account, the Chooser agrees to notify the Publisher immediately and, if necessary, to reset their login credentials.
- Uninstalling the Application
Uninstalling the Application by the Chooser, for any reason, does not result in the automatic deletion of their personal Account or the termination of the Services they have subscribed to, including any current Subscription.
The Chooser remains responsible for any contractual obligations in effect at the time of uninstallation, particularly with regard to pending payments or automatic Subscription renewals. It is the Chooser’s responsibility to first take the necessary steps to cancel or delete the Account in accordance with the terms set forth herein.
Uninstalling the Application does not interrupt the processing of data previously collected in accordance with the Privacy Policy accessible via the Application, the Landing Page, and/or the Application’s Website. It also has no retroactive effect on permissions already granted.
The Chooser may, at any time, reinstall the Application and, provided the Chooser uses the same login credentials, regain access to their Account and service history.
The Publisher shall not be held liable for an isolated uninstallation that is not followed by the necessary steps to effectively close the Account or terminate recurring payments.
- Account Deletion and Suspension
- Deletion by the Chooser
The Chooser may, at any time and without notice, permanently delete their Account, either directly from the mobile app, in the “Settings” tab (top right of the profile) within the app, or via the form provided for this purpose, accessible on the landing page and/or the app’s website.
As a result, the Chooser’s profile will be permanently deleted.
When the Account is deleted:
- The Chooser’s profile will be hidden from other Choosers.
- The Chooser’s data will be retained for a period of 1 year from that date, in particular to comply with the legal obligations incumbent upon the Publisher as set forth in the Privacy Policy, and will then be permanently deleted at the end of that period.
Furthermore, the deletion of the Account by the Chooser does not cancel or delete any Subscriptions that have been purchased. To cancel a Subscription, the Chooser must go to the Subscription management settings in the App Store and the Play Store, as indicated in Section 8.6 herein.
Account deletion is permanent. If the Chooser wishes to resume using the Application, they must register under the same conditions as for an initial registration, as provided for in Section 10 of these Terms of Use.
The Chooser will not be able to reactivate their old Account.
- Suspension or Deletion of the Account by the Publisher
- Suspension or Deletion of the Account in the Event of a Breach of the Terms of Use
In the event of a Chooser’s breach of the Terms of Use, their Account may, at any time and following prior notice, be suspended as a precautionary measure for a reasonable period and then automatically terminated by the Publisher.
The Publisher may suspend the Chooser’s Account for the time necessary for its Services to conduct investigations following a report in accordance with Section 12.19 herein or in the event of an alleged breach of the Terms of Use that can be remedied.
In its decision to suspend the Account, the Publisher will take into account the severity of the violation and whether it is a repeat or isolated incident.
As part of the aforementioned review, the Publisher may need to request information from the relevant Chooser in order to assess compliance with the Terms of Service and the Code of Conduct (Article 12 herein), including Personal Data such as the phone number and/or email address associated with the Chooser’s Account for the purpose of authenticating the Chooser.
The Chooser is invited to contact the Publisher’s customer service team via email to obtain further information regarding the reasons for the suspension of their Account, to submit any comments, and/or to provide proof that the violation has been rectified. The Chooser may also utilize the internal complaint-handling system established by the Publisher.
If, within 30 days of receiving notification of the Account suspension, the Chooser has not contacted the Publisher’s customer service department or if the information provided by the Chooser has not resolved the violation, the Publisher may notify the Chooser of the termination of their Account via the Application and/or by email and inform the Chooser of the period during which they will be unable to re-register for the Application. Unless otherwise specified, this period is set at 1 year from the date of notification of the Account’s termination.
The deletion of the Account entails the consequences detailed in these Terms of Use.
In any case, no refunds will be issued for Subscriptions or other paid Services or features.
- Deletion of Inactive Accounts
The Publisher deletes Accounts that have been inactive for a continuous period of 1 year.
An Account is considered inactive if the following criteria are met:
- The Chooser App has not established contact with Choose for Real’s servers (in particular due to the geolocation option being disabled); and
- The Chooser has not used the App.
In any case, the Account of a Subscribed Chooser is not considered inactive.
The Chooser will be notified by email, at the address provided in the App, of the deletion of their Account with 8 days’ notice.
The Chooser may, at any time during the notice period, reactivate their Account, which will suspend the termination process. All profile content will then be retained by the Chooser.
At the end of this notice period, and in the absence of any response from the Chooser, the Account will be automatically deleted by the Publisher.
The deletion of the Account entails the consequences detailed in these Terms of Use.
The Chooser will not be able to reactivate or request the reactivation of their former Account.
- Code of Conduct for Choosers
- General Principles of Conduct
Any User of the App, referred to as a “Chooser,” agrees to conduct themselves in a respectful and responsible manner and in compliance with applicable laws. To become a Chooser, you must meet all of the following conditions:
- Be of legal age as defined by French law (be at least 18 years old). Use of the App is strictly prohibited for individuals under 18 years of age. - Agrees to regularly update the information provided by accessing their Account through the App.
- The Chooser acknowledges having read these Terms of Use and accepts them by confirming their registration.
- The Publisher has neither the legal obligation nor the technical means to verify the identity and age of members. - For the duration of the investigation, the Publisher reserves the right to suspend the suspected Chooser’s Account and their access to the Application and to carry out the necessary verifications, in particular by requesting a copy of an official identification document.
- If the Chooser is unable to provide such proof, or in the event of a proven violation of these Terms of Use, the Publisher may terminate the account of the Chooser in question in accordance with the conditions described in Section 11.3 herein.
- The Chooser agrees to maintain only one Account. Otherwise, the Publisher may delete any subsequent Accounts, in accordance with the terms set forth in Section 11.3 herein.
- Obligation of Good Faith and Honesty While Using Choose for Real
To remain a Chooser, you must comply with all of the following conditions:
- Be honest and truthful in your statements.
- Upload only photos and/or profile information that clearly identify the Chooser, and at a minimum, upload a profile photo as defined below (Section 12.7), that is, where your face is clearly recognizable, as these are two fundamental criteria for using the Services; and exclude photos and/or information featuring third parties or elements unrelated to the Chooser, such that the Publisher reserves the right to remove, at its discretion, any photo and/or profile that does not comply with these Terms. The use of photos generated by a generative artificial intelligence (GAI) system is prohibited.

- The Chooser is also prohibited from copying, distributing, and/or transferring any technical data that they may intercept on the network in connection with the Choose for Real App.
- Furthermore, in the event of clearly abusive or excessive behavior by the Chooser—particularly behavior that is deemed to be of a certain nature and/or unfounded—with the intent to use the paid Services offered on the Application for free, the Publisher reserves the right to suspend the Chooser’s Account in accordance with the terms of Section 11.3 of these Terms of Use.
Choosers also agree to comply with the following Terms of Use:
- Do not transmit or exchange static and/or animated content that is offensive, sexually explicit, illegal, dangerous, violent, harassing, disrespectful, defamatory, or threatening;

Sending messages for marketing and/or commercial purposes and/or newsletters via the App’s messaging system that include, but are not limited to, content, instructions, or hyperlinks to websites or media belonging to third-party companies—particularly those competing with the Publisher—is strictly prohibited.
- Distribution of Content
The Chooser is solely responsible for the Content it distributes through the App, and the Publisher shall in no event be held liable for the communication of such content.

- Contrary to the Terms of Service in any way.
Although the Publisher is under no obligation to pre-screen content, it may nevertheless be required to intervene to ensure the safety of Choosers. The Publisher therefore reserves the right to review, filter, reject, and/or remove any content, including content exchanged by Choosers via Messaging, in accordance with these Terms of Use.
Any breach of the aforementioned obligations constitutes a material breach of these Terms of Use and may result in the termination of the Account in accordance with Section 11.3 hereof.
- Use of the Internal Messaging System
As part of the Messaging features made available through the App, Choosers may exchange various types of content. These exchanges are strictly regulated to ensure a respectful, safe, and legally compliant space for interaction.

- To perform automated or manual moderation of reported content;
- To retain certain communications for evidentiary purposes in the event of a report or suspected unlawful conduct, in compliance with applicable personal data protection laws.
- Misuse of the Internal Messaging System
Choosers acknowledge that the Application’s internal messaging system is a private space for communication made available exclusively for the purpose of courteous, voluntary , and respectful interactions between Users located in the same public place and simultaneously using the Application.
As such, it is strictly prohibited for any Chooser—under penalty of suspension or permanent deletion of the Account and possible legal action—to engage in behavior constituting misuse of the Messaging system, including but not limited to:
- Sending Messages repeatedly, persistently, or unsolicited to one or more other Users, despite the absence of a response or an explicit refusal to continue the exchange (harassment);

- Reporting and Moderation
In a constant effort to ensure safety, respect for individual freedom, and compliance with applicable laws, the Publisher provides Choosers with reporting tools designed to identify any behavior or content that is illegal, inappropriate, or contrary to these Terms of Use.
Any Chooser may report, directly from the App’s interface, a Message, a photo, content, or a User if they believe the behavior in question may constitute, in particular:
- Harassment or an attempt at unsolicited contact;
- A violation of the Code of Conduct;
- Impersonation or a false statement;
- Content that incites hatred, violence, or discrimination, or that violates the law;
- Unauthorized solicitation of a sexual or commercial nature.
Each report is subject to a confidential and prompt review by the Publisher’s teams, in accordance with the principle of due process whenever possible. The Publisher reserves the right, after verification, to:
- Temporarily or permanently suspend an Account;
- Disable the messaging feature or certain functionalities;
- Notify the appropriate authorities in the event of criminal conduct.
Choosers are expressly informed that misuse of the reporting feature (false, malicious, or repeated reports without serious cause) constitutes a violation of the Terms of Service and may result in appropriate sanctions.
- Responsible Use of Photos and Visual Content
When using the App, each Chooser agrees to comply with the following rules regarding the publication and management of photos and visual content, including profile photos:
- Authenticity and Compliance
The Chooser agrees to post only authentic photographs that personally depict them. The content posted must not misrepresent their actual appearance. The misuse of filters or photo-editing techniques is prohibited when it substantially alters facial recognition or identity.
- Respect for the Rights of Others
It is strictly prohibited to post photographs:
- Depicting a third party without their express and informed consent;
- That infringe upon the right of publicity, privacy, or intellectual property rights of third parties;
- Taken from celebrities, public figures, or images from image databases, with or without authorization.
- Prohibition of Inappropriate Content
All photos or visual content of a pornographic, sexual, exhibitionist, violent, discriminatory, or hateful nature, or that infringes upon human dignity and decency, and, in general, is contrary to public morality, is strictly prohibited. The publication of such photos constitutes a serious violation, which may result in the suspension and/or termination of the Chooser’s Account pursuant to Section 11.3 of these Terms of Use, without prejudice to other penalties that may be imposed by a court of law.
- Moderation and Liability
The Chooser remains solely responsible for the images posted. The App Publisher reserves the right, at any time and without notice, to remove any visual content deemed non-compliant with these provisions, and to suspend or terminate the account of the User at fault.
- Processing for Profile Verification Purposes
For the purpose of profile verification, certain photographs may be temporarily collected and analyzed by a secure verification system, in compliance with applicable laws regarding the protection of Personal Data (including the GDPR). These images will under no circumstances be used for any other purpose.
- Confidentiality of Communications
The Publisher guarantees to Choosers that communications exchanged via the internal messaging system are strictly private, encrypted, and under no circumstances accessible to other Users or third parties, except in the event of:
- A formal report of conduct that is unlawful or in violation of these Terms of Use,
- An express and substantiated request from a competent judicial or administrative authority,
- A clear violation of security or conduct rules.
Choosers, for their part, agree to respect the confidentiality of the messages they receive, in particular by refraining from:
- Publishing, transmitting, or reproducing all or part of a private conversation without the express consent of the author or recipient;
- Recording or disseminating, in any form whatsoever, communications without a legal basis or explicit authorization.
Any breach of the confidentiality of communications may result in disciplinary action, including suspension or deletion of the Account, without prejudice to civil or criminal proceedings.
- Geolocation and Determination of the Meeting Place
To enable interactions between Choosers sharing the same public space (bar, restaurant, outdoor seating area, theater, rooftop, or club, etc.), the Publisher offers a voluntary geolocation feature that allows Choosers to:
- Enable location detection to access specific features (e.g., sending a “Wink,” sending a “Drink” or “Gift,” interacting with profiles visible on-site);
- Manually select their current location from a predefined list or from options suggested by the interface.
Enabling geolocation is entirely optional, but the App’s features will only be accessible if the User’s actual location in a public place is identified, in order to ensure consistency between the actual meeting and the digital use of the App.
The Publisher agrees to collect location data only for the immediate functional needs of the App, without improper archiving or transmission to third parties for commercial purposes. The User may disable geolocation at any time via the App’s settings.
- Prohibition on Altering Location Through Technical Means
Use of the App is strictly contingent upon the accuracy and authenticity of the Chooser’s geographic location, for the sole purpose of facilitating interactions between people who are physically present in the same public place.
As such, the Chooser is expressly prohibited, under penalty of the sanctions provided for in these Terms of Use, from:
- From using any tool or software that conceals, modifies, or simulates their actual location, such as fake GPS applications, signal-bypassing tools, or developer settings that alter location data;
- From using a virtual private network (VPN), a device emulator, or any similar device intended to circumvent the geographic location verification systems implemented by the Publisher;
- Attempting to access geolocation features from a location where the user is not actually present or manipulating the detection system to appear in a different location.
The Publisher reserves the right to conduct any necessary technical verification, in compliance with applicable regulations, to detect this type of fraud. If such manipulation is detected, the Publisher may, without prior notice:
- Temporarily or permanently restrict access to the services;
- Deactivate or delete the affected Account;
- Take any appropriate action in the event of harm or a clear violation.
These measures are intended to ensure the integrity of the service and to protect the safety of Users within the context of genuine, localized interactions.
- Unsolicited Interactions and Respect for Consent
The App is based on the fundamental principle of freedom of interaction and mutual respect among Choosers. No User is required to respond to a request, accept an offer, or justify a refusal.
As such, the following are strictly prohibited:
- Persistent follow-ups in the absence of a response to a “Wink,” a “Flower,” a “Drink,” a “Gift,” or a “Message”;
- Any attempt to circumvent a User’s refusal;
- The repeated use of icons or Messages for the purpose of imposing unwanted contact.
Each User has tools available to block, report, or restrict interactions with another profile. The Publisher reserves the right to suspend or terminate any Account exhibiting behavior deemed intrusive, inappropriate, or non-consensual.
Failure to respond or refusal to engage in an interaction constitutes a legitimate exercise of the right to reserve judgment or withdraw, which shall not give rise to any form of retaliation, either within the App or outside of it.
- Provision Regarding the Prevention of Prostitution
The Choose for Real App is a social and user-friendly matchmaking platform based exclusively on free, reciprocal, and consensual interactions between Users. Under no circumstances may the Services offered be interpreted as a marriage brokerage, a sexual service, or the facilitation of paid relationships, all of which are prohibited by law. Any attempt to misuse the App for the purposes of prostitution, sexual solicitation, or illicit trafficking will result in the immediate suspension of the Account in question, without notice or compensation, and may be reported to the appropriate authorities.
- Account Management
The Chooser must regularly check their Inbox and notifications, through which the Publisher will keep them informed, among other things, of information regarding its Services and any changes or updates that may be made. This information may also be sent via email to the Chooser’s email address provided during registration.
The Chooser may access the Services associated with their Account by logging into the Application using a confidential username and password. The Chooser is solely responsible for their login credentials and must ensure that no third party can access them.
- Equipment
The equipment (hardware or software) required to access the Services, as well as all other related costs, including telecommunications charges, are the sole responsibility of the Chooser. The Chooser is solely responsible for the equipment used in connection with the Service.
- Respect for Personal Freedom and Consent
Interaction between Choosers is based exclusively on individual freedom. Each Chooser remains free to accept or decline any request—whether it be a “Wink,” a “Flower,” a “Song,” a “Drink,” a “Gift,” or any other form of interaction—without justification or obligation.
Accepting an item does not imply any additional rights or obligations. The App Publisher does not intervene in any way in the course or outcome of the exchange and does not guarantee any results.
- Authenticity and Accuracy of Profiles
The Chooser agrees to provide truthful information, keep their profile up to date, and comply with the verification procedures in place. The use of fake profiles, concealment of identity, or misappropriation of Personal Data is strictly prohibited.
- Alcohol Awareness
Sending a “Drink” via the App is exclusively a digital and symbolic gesture allowing a Chooser to express a friendly intention toward another User. This gesture has no monetary value and does not involve any transfer of funds, any financial transaction, or any actual provision of a beverage.
Under no circumstances should it be interpreted as an encouragement to consume an alcoholic or non-alcoholic beverage. Each User remains solely responsible for their choices, consumption, and behavior.
The Publisher acts solely as a technical service provider making digital interaction features available and disclaims all liability for any behavior, decisions, or incidents that may arise as a result of interactions between Users.
- Prohibition on Misuse of Features
The features offered may not be misused for manipulative, offensive, commercial, or public order-violating purposes.
- Reporting Illegal Content
Any content that violates these Terms of Use may be reported by any Chooser to the Publisher by clicking on the “Report User” feature.
This feature is accessible directly from each profile by clicking on the icon with three horizontal dots located in the upper-right corner of the relevant User’s profile page. A drop-down menu then allows the User to select the “Report User” option.
The User whose posted content is the subject of a report will under no circumstances be informed of the identity of the Chooser who filed the report.
In the event that content is published that has been the subject of a reporting procedure and may constitute a violation under applicable laws and regulations, the Chooser affected by this content may also be invited to contact the relevant authorities.
In accordance with the provisions of Law No. 2004-575 of June 21, 2004, on confidence in the digital economy, any person who reports content or activity to the Publisher as being unlawful with the intent to have it removed or to halt its distribution, while knowing that such information is inaccurate, is liable to a penalty of one year’s imprisonment and a fine of 15,000 EUR.
- Blocking Another User
Outside the scope of the reporting procedure detailed in Section 12.6.6 of these Terms, Choosers have the right to block any User whose behavior does not comply with the rules of decorum.
Blocking another Chooser will prevent all communication with that user, including the inability for either party to access or send messages.
- In-Person Meetings
Since the App is used in shared public spaces, the Chooser agrees to behave responsibly, in a non-intrusive manner, and with respect for the peace and quiet of others and the shared space. The User remains personally responsible for their conduct during an in-person interaction.
The Publisher emphasizes Real-Life Meetings, where a User first encounters another User in a public place (such as a café, bar, outdoor terrace, rooftop, or club, etc.), and then they can use the App to start a conversation.
The Publisher does not conduct any criminal background checks on Users. Users may block any other User whose behavior they find objectionable, but the Publisher does not investigate Users’ backgrounds. The Publisher assumes no responsibility for Users’ behavior.
These In-Person Meetings take place independently of the Publisher and are the sole responsibility of the Users.
Choosers must be aware that they bear full responsibility for any interactions that follow the in-person meeting. The Publisher strongly recommends not sharing sensitive personal information (phone number, address, last name) before the in-person meeting and to do so with caution and discretion.
The Publisher strongly recommends arranging meetings in busy public places, informing a trusted friend or family member of the location and time of the meeting, and exchanging contact information only after a reasonable amount of time has passed and under safe conditions.
The Publisher shall not be held liable for any act, damage, or problem arising from interactions and meetings resulting from the use of the App.
- Safety Guidelines for In-Person Meetings
The Publisher expressly reminds Choosers that any In-Person Meeting initiated through the App is based exclusively on the free and mutual consent of the Users. Under no circumstances does the Publisher intervene in the organization, supervision, or conduct of these in-person meetings, which take place under the sole responsibility of the individuals involved.
It is the responsibility of each Chooser to act with caution, respect, and vigilance during any interaction or meeting, particularly by choosing public places, informing a trusted third party, and ensuring mutual respect for consent. The Publisher disclaims all liability in the event of any incident, dispute, or damage resulting directly or indirectly from an interaction or a Meeting between Choosers, including but not limited to cases of abusive, fraudulent, violent, or public order-violating behavior.
- Chooser’s Responsibility
The Chooser is solely responsible for their actions and the data they publish via the App.
If the Publisher were to be held liable as a result of the Chooser’s failure to comply with their obligations, the Chooser shall indemnify the Publisher against any judgment rendered against the Publisher arising from the Chooser’s violation of the law or these Terms of Use.
The Chooser may report illegal content that violates laws, regulations, or these Terms of Use using the reporting tools provided by the Publisher in accordance with Section 12.6.6 of these Terms of Use.
Any breach of the obligations set forth in this Code of Conduct constitutes a material breach of these Terms of Use and may result in the termination of the Account in accordance with Section 11.3 of these Terms of Use.
The Publisher shall not be held liable for the use that other Choosers may make of Content shared, posted, or made available to them by a Chooser through the Application; each Chooser is and remains solely RESPONSIBLE for the decisions they make and the choices they make.
- Obligations and Responsibilities of the App Publisher
- Guarantee of Technical Resources and Service Security
The publisher of the Choose for Real App strives to provide the infrastructure and technical resources necessary to deliver a Service that meets quality standards and is accessible to Users with compatible mobile devices and an up-to-date version of the iOS or Android operating systems, as supported by the App at the time of use.
The Publisher shall not be held liable for any malfunction related to the device used by the User, nor for any incompatibilities between the App and said device, nor for the performance or stability of the User’s Internet connection, which falls under the responsibility of the User’s Internet service provider.
As part of its cybersecurity obligations, the Publisher implements appropriate technical and organizational measures to protect data and prevent unauthorized access to information systems. These measures include, in particular, firewalls and isolated environments between internal networks and the Internet. Despite these precautions, which are in line with industry best practices, the Publisher notes that no computer system can guarantee absolute security.
The Publisher shall not be held liable for any interruptions, outages, data loss, delays, or malfunctions of the Service resulting from a force majeure event, a failure on the part of the Internet service provider, external hacking, or any other factor reasonably beyond its control.
It is each User’s responsibility to ensure the confidentiality and security of their means of access (email address, password, personal device, etc.). In the event of negligence or a lack of vigilance, the User Account could be compromised, although this scenario remains rare given the measures implemented by the Publisher.
The Publisher also draws the User’s attention to the possibility—albeit rare—of receiving unsolicited messages (spam) or emails impersonating the Application (phishing). In case of doubt or a suspicious incident, the User is advised not to click on any links , to immediately report the incident to the Publisher, and to write to the address specified in Article 27 of these Terms of Use.
- Disclaimer of Liability for Illegal Conduct
The Publisher shall not be held liable, under any circumstances, for any unlawful acts or conduct committed by Users via the Platform, including, but not limited to:
- Any fraud, attempted scam, or fraudulent manipulation;
- Any covert commercial activity, unauthorized solicitation, or canvassing;
- Any act or incitement to prostitution, or solicitations of a sexual nature for payment;
- Any form of money laundering, illicit transfer of funds, or transaction intended to conceal the origin of financial resources;
- Any identity theft, use of false information, or forgery of documents;
- Any infringement of intellectual property rights (copying, distribution, or unauthorized use of protected works);
- Any infringement of personality rights, including the right to one’s image, privacy, honor, or reputation;
- Any use of the Application for purposes contrary to the law, public order, or public decency.
Such conduct, which is strictly prohibited, constitutes a serious violation of these Terms of Use and may result, without prior notice, in the immediate suspension or termination of the User Account in question, in accordance with the provisions set forth in Section 11.3 above.
The Publisher further reserves the right to report any manifestly unlawful conduct or activity to the competent judicial or administrative authorities, in compliance with its legal obligations.
- Implementation of a Community Reporting and Moderation System
In accordance with Article 8 of Regulation (EU) 2022/2065 of October 19, 2022, on a Single Market for Digital Services (“Digital Services Act” or DSA), the Publisher, in its capacity as a content host under European Union law, is not subject to a general obligation to monitor content transmitted or stored via the Application.
Nevertheless, in accordance with Article 16 of said regulation, the Publisher implements an accessible, clear, and effective reporting system enabling any Chooser to report any illegal, abusive, or manifestly harmful content.
Once a notification is received, the Publisher undertakes to have its teams conduct a prompt review of the report. If the content is deemed manifestly unlawful or in violation of these Terms of Use, it will be promptly removed or made inaccessible. This action may result, where applicable, in the suspension or termination of the content creator’s Account, in accordance with Section 11.3 herein.
The reporting system covers, in particular, but is not limited to, the following cases:
- Glorification of crimes against humanity, incitement to commit terrorist acts, or the glorification of such acts;
- Incitement to hatred, violence, or discrimination based on gender, sexual orientation or gender identity, disability, race, or religion;
- Child pornography or the distribution of non-consensual sexual images;
- Harassment, threats, abusive language, or violations of human dignity or fundamental rights;
- Comments contrary to decency or the spirit of the community.
The reporting feature is available directly through the App’s interface: from each profile, by clicking on the icon depicting three horizontal dots located at the top right of the relevant User’s profile. A drop-down menu then allows the User to select the “Report User” option.
The person filing a report remains strictly anonymous: the User who posted the reported content will not be informed of the complainant’s identity.
Regardless of the reporting system, any User may block another User whose behavior or communications are deemed inappropriate. This action results in an immediate and mutual termination of all interaction. This feature is confidential.
In the event that content constitutes a criminal or civil offense, the internal reporting procedure does not replace the need to contact the appropriate authorities. The User is encouraged to file a complaint and pursue any appropriate legal remedies with the relevant courts or agencies.
Furthermore, in accordance with its Privacy Policy, the Publisher implements enhanced measures to ensure a safe, respectful, and legally compliant environment.
Any abuse of the reporting system (unfounded, repeated, or malicious reports) constitutes a serious violation of these Terms of Use. It may result in disciplinary action, including the suspension or closure of the affected Account in accordance with the provisions of Section 11.3.
- Reminder of the Rules of Caution and Vigilance
Each User remains fully and exclusively responsible for verifying the identity of the Users with whom they choose to interact, whether in connection with the Use of the Services and features of the App based on In-Person Meetings between Users.
The Publisher acts as a technical intermediary facilitating connections and shall in no event be held liable, under any circumstances, for any incident, damage, harm, or reprehensible behavior occurring during a physical or virtual meeting, including in cases of false identity, assault, harassment, or any other harmful circumstance.
The User expressly acknowledges that it is their responsibility to exercise good judgment, caution, and vigilance, both when communicating with other Users and when organizing any interaction, whether online or offline.
The Publisher disclaims all liability in the event of failure to comply with these basic safety precautions.
- Prohibition on Collective Gatherings via the Application
Any use of the Services provided by the Publisher for the purpose of organizing, planning, or promoting a gathering or collective event among Users, outside the strictly personal and private context provided for by the App, constitutes a clear misuse of the Service’s intended purposes.
It is strictly prohibited to use the App to coordinate, directly or indirectly, a demonstration on public roads or in any space accessible to the public, whether or not such a demonstration has been declared or authorized by the competent authorities.
In the event that such a gathering nevertheless takes place at the initiative of one or more Users, the Publisher shall under no circumstances be held liable, particularly in the event of:
- Disturbances of public order;
- Threats to the safety of persons or property;
- Failure to comply with legal or regulatory obligations applicable to this type of gathering; or
- Any resulting property damage, bodily injury, or emotional distress.
Users are solely responsible for their actions and decisions regarding their use of the Application, including any unauthorized or collective use.
- Symbolic Nature of Gifts and Drinks – Limitation of Liability
The “Gifts” and “Drinks” offered within the Choose for Real App are exclusively digital content and symbolic gestures intended to facilitate interactions between Users. They have no monetary value, do not involve any transfer of funds between Users, and cannot be considered a purchase, order, reservation, or provision of goods or services.
The sole purpose of these features is to allow Users to express interest and, where applicable, to access the internal messaging system, subject to the recipient’s express consent.
The Publisher does not, under any circumstances, intervene in the organization, arrangement, or conduct of in-person meetings between Users, nor in the provision of goods or services outside the App. Any initiative to meet or make a purchase in a public place is the sole responsibility of the Users involved.
Consequently, the Publisher disclaims all liability:
- With respect to the quality, compliance, safety, or availability of any goods or services consumed outside the App;
- With respect to relationships, conduct, or interactions between Users, including during Meetups;
- With respect to any damage—whether direct or indirect, tangible, intangible, or physical—that may result from such interactions or personal initiatives.
It is expressly stated that the Publisher acts exclusively as a technical service provider making a digital platform for connecting users available. Any claim or action relating to matters outside the App must be directed directly against the third party or parties concerned.
The User acknowledges and agrees to use the App at his or her sole risk and waives, to the extent permitted by applicable law, any claim against the Publisher for any damages, whether direct or indirect, resulting from interactions or meetings between Users.
- Content Accessible Through the Services
When using Choose for Real’s Services, the User may be exposed to content posted by other Users that they may find offensive, inappropriate, inaccurate, or in violation of applicable law.
The Publisher, acting as a content host within the meaning of applicable regulations, does not exercise any systematic editorial control over Users’ posts. It therefore makes no warranties or representations regarding the accuracy, legality, compliance with copyright laws, decency, or relevance of such content.
By accessing the Application’s Services, the User acknowledges that the Publisher cannot be held liable for such content and expressly releases the Publisher from any claims or actions related thereto.
- Third-Party Services.
The App’s Services may contain links to third-party websites or services that the Publisher does not own or control (for example, links to Google, Apple, or music apps, etc.).
The User may also need to use a third-party product or service to access certain Choose for Real Services (such as a compatible mobile device to use the mobile apps).
When a User accesses these third-party services, they do so at their own risk. These third parties may require the User to accept their own terms of use. The Publisher is not a party to these agreements; they are entered into solely between the User and the third party.
- Disputes with Other Users
If a User finds themselves in a dispute with another User of the App’s Services or with a third party, the Publisher encourages the User to contact the other party and attempt to resolve the dispute amicably.
- Dispute Resolution System.
Users who are unable to resolve a dispute related to an interaction conducted through the App’s Services are encouraged to seek an amicable resolution.
The Publisher may, at its sole discretion, offer a mediation process designed to facilitate the resolution of disputes between Users. However, the Publisher is under no obligation whatsoever to handle, resolve, or intervene in disputes between Users.
In any event, the Publisher does not exercise any judicial function and cannot substitute for the competent authorities in settling a dispute or ruling on legal claims.
- Disclaimer of Liability by the Publisher.
By using Choose for Real’s services, the User expressly releases the Publisher from any liability for any claims, demands, or damages arising from disputes with other Users or third parties. The User agrees that the Publisher shall not be held liable for any personal or commercial disputes, or for any bodily injury, property damage, financial loss, or other damages resulting from interactions or transactions between Users or with third parties via the platform.
- User Liability in the Event of a Dispute.
In the event of a dispute concerning a physical interaction between Users, particularly if damage or harm occurs, the User agrees to resolve the dispute directly with the other User involved and to take all necessary measures to ensure their safety. The Publisher shall under no circumstances be involved in such disputes and disclaims all liability for incidents occurring during physical meetings, interactions, or transactions.
- Indemnification
The Chooser agrees to indemnify, defend, and hold harmless the Publisher from any and all claims, demands, damages, losses, liabilities, costs, or expenses (including attorneys’ fees) arising from a breach of these Terms of Use, improper use of the Application, or any wrongful conduct attributable to the Chooser, to the extent permitted by applicable law.

The updated list of these bodies is published on the European Commission’s website.
